| Rother District Council proposes two bye-laws that firstly ban fishing on the beach in a designated area from 9.00 to 18.00, from 1st May to 30th September. Secondly, they propose a bye-law that forbids fishing 'in such a manner as to cause danger, obstruction or annoyance to any person using the seashore'. This applies to the WHOLE of Rother shoreline e.g. Pevensey Bay, Herbrand Walk, Bexhill and Pett Level to Camber. This could well be the thin end of the wedge with other councils following suit. I also thought that Magna Carta protected the right of free born to pursue activities relating to fishing on the tidal bounds of the shore. This includes bait digging. You are right it is the thin edge of a worrying little wedge. I'll try again with the epetition again. | Re: Bexhill-on-Sea Beach Fishing Ban Bye-law I think that Rother district council will have not only a fight on their hands, but may come up against common law on this one. As you all rightly pointed out, the Magna Carta of 1215 states the freedom of use. Current law states that the caost between the low tide and high tide watermarks are property of HM The Queen, and as such British subjects of the Monarchy of the day, have the right to fish and use for recreation the WHOLE British coast line. The only exceptions at present are Nuclear power stations, or military installations on the coast, and that is only in the interest of national security, which we as fishermen and women go along with because we all possess common sense.
