| What's the punishment Does anybody know, where an angling club own the fishing rights to a stretch of water, that otherwise would be fishable under a regular licence. What action can be taken against you if you fish it and get caught. I only ask because I went to fish a stretch of canal at Burbage only to be told that there was no longer any free fishing on the canal anymore? I moved on but am curious as to what might have happened had i ignored the person and just sat there fishing away for Mr Pike? |

| Re: What's the punishment I believe that the fishing rights invovle the 6 feet of bank adjacent to the water, and as such the holder of the fishing rights can prosecute for trespass, I am not certain of this but that is what I understand. I am sure someone will know, I know that the fish do not belong to anyone but there may be a case of theft if the water has been stocked by a club, but in theory if you catch and release no theft has occurred. It used to be the case that it was legal to fish any water from a bridge as you were not bankside but I believe that loop hole has been close by making it an obstruction offence. Not sure about that one. I would imagine that if there are no clearly displayed signs saying private fishing & as long as you have an environment agency rod licence, they could only ask you to leave. | Re: What's the punishment You cannot be prosecuted for tresspass it is just an open threat. You can only be done for tresspass if you comit criminal damage. Think its just the sign of the times Bolts we are being dictated to left right and centre. I also heard a few times that any river that passes directly through a town centre cannot be private and free to all, but i dont know how true this is either. |

| Re: What's the punishment I think, that if you aren't fishing a privately stocked lake or river, such as a canal, that all the club can do is ask you to move on, I can't think that they have the power to remove you or your equipment as this would constitute both theft and or assault on their part, want to get to the bottom of this one, as it bugs me that you can't just turn up and fish anymore. |
