common lakes & ponds may i start with saying that i do try to abide with the law. my understanding of common land, ponds & lakes allows anyone to roam, graze livestock & fish without charge as it effectively belongs to the crown & therefore the public. please tell me if i'm wrong, or what the exact law is. there is a common pond i know, that has been fished for many years without an problems, it used to be looked after by the neighbouring golf course, part of which was on common land itself. the story i know is that the golf course decided it wanted to start charging for fishing, but a local farmer objected & in no uncertain terms, told the golf club that if they charged for fishing on a common pond, then he would excercise his rights to graze his livestock on all the common land, including that controlled by the golf club. not wanting the course damaged by livestock, they backed down & we could continue fishing for free. skip forwards a few years ... the pond is now controlled by an angling club who decided to charge for fishing & many fisherpersons knew nothing about the change of control untill they started being asked to pay up. obviously i know & accept that if a pond, lake or river is stocked & looked after by a club or organisation, then they have the right to charge for fishing that venue. but if it is a common lake or pond & someone refuses to pay, claiming it is their legal right to fish the common pond for free, then does the baliff/fee collector have the right to evict that person from the venue, even though they have a valid licence? i'm not looking to cause an argument, this is just something that i have been pondering about & would like to discuss.

Re: common lakes & ponds a very interesting question, i have no answer i'm afraid, did the angling club go down a legal route to acquire the fishing rights or not ? maybe the EA could answer your question

Re: common lakes & ponds hi paul, hopefully i've not opened a can of worms (excuse the pun lol) with this question. i don't know how they got the control of the pond, but it's listed on their website & other 'where to fish' type websites. may well be worth asking the ea. thanks

Re: common lakes & ponds have fired off an email to the environment agency, got to wait up to 10 days for a reply ... do they work slower than my foreman? tried the county, local, parish & the nearest town council, but none appeared to say which was responsible, may just fire off an email to all & see what happens, but the speed the councils here work at, they make my foreman look like lightning lol

Re: common lakes & ponds update ... environment agency couldn't help, gave me the link to the land registry office, but couldn''t find any reference to the pond there, so doesn't look like it's been bought. wat at my parents fishing today & asked them if they knew which council to try & will be firing an email off tp them later.
